Tutoring Service Agreement
As part of the onboarding process for Brooklyn Math Tutors (BMT), all tutors are required to review and sign our Tutoring Services Agreement.
This legal contract establishes the professional relationship between you and BMT, outlining your responsibilities, protecting our client relationships, and ensuring compliance with legal and operational standards in New York City and State.
Why is this agreement important?
- Clarity and Expectations: It defines your role as an independent contractor and sets clear expectations for professionalism, scheduling, communication, and service documentation.
- Protection of Client Relationships: It safeguards BMT’s business by preventing solicitation or direct engagement with clients outside of our platform, which is essential to our operations.
- Legal Compliance: It ensures both you and BMT understand the terms of payment, confidentiality, and other key legal aspects, aligning with New York requirements.
What does the agreement cover?
Here’s a summary of the key sections:
- Tutor Responsibilities: Guidelines on maintaining professionalism (e.g., confidentiality, academic integrity), managing sessions and scheduling (e.g., punctuality, cancellations), communicating effectively with BMT and clients, and documenting your services.
- Protection of Client Relationships: Policies on non-solicitation, handling referrals, and ensuring all work with BMT clients is conducted through our platform. This includes penalties for violations to protect BMT’s business interests. For a no-nonsense guide on how to handle poaching requests from clients or referrals, see Handling Poaching Requests. If you have questions about this, reach out to us anytime.
- Performance and Compliance: Expectations for meeting your obligations and the steps BMT may take (e.g., reducing assignments or termination) if issues arise.
- Legal and Contractual Terms: Details on your status as an independent contractor, tax compliance (e.g., providing a W-9), payment terms (e.g., direct deposit), confidentiality, intellectual property, and more.
Please read the agreement carefully
